Bonjour!

Me:

A quick question: my Russian colleagues are very excited by the scan and would like permission to post it online on a public site (not behind a passworded wall). Would this be okay with you?

UNCG:

I am glad that you and your colleagues are pleased. UNCG owns the physical item, not the copyright. There are no permissions for me to grant - the item was scanned for your use.

Lester S. Levy Sheet Music Collection, John Hopkins' University, Baltimore, Maryland

Dear Jim.

I've began to work with the images you've provided.

Actually, I'm running an online dance bibliography project located here:

https://bib.hda.org.ru/bib

I'd like to put some url to the items you've provided. As you know, most of them are erroneously marked as copyrighted on your website. Here is an example: http://levysheetmusic.mse.jhu.edu/catalog/levy:041.012

I wonder if it's okey for me to provide a link for downloading pdf obtained from Lester S. Levy collection. Here is an example of such item (Lester S. Levy collection will be mentioned in the filename of the downloaded item): https://bib.hda.org.ru/bib/books/lindrot_1864

With best regards,

Yuriy.

Yuriy,

Please feel free to add any links you wish. Since those pieces are in the public domain, they may be used in any way you wish.

The problem with the erroneously copyright-protected music is a serious one, especially for me since I’m the one who gets to field indignant inquiries asking if I understand anything at all about copyright (and no, your inquiry was not one of those). Yes, I do have an understanding of copyright as it applies to our holdings (though I am not a lawyer), but I had nothing to do with the redesign of the Levy site a couple years ago that resulted in this problem. I wish it could be corrected soon but, unfortunately, that will probably not happen since it would require a programmer to locate the source of the problem, and then a “search and destroy” project to eliminate all of the individual places where it occurs. I’ve been told there is no money for such a clean-up project and it’s a low priority in the overall scheme of things.

So if you want to add these pieces to your site, please go right ahead. We would appreciate a citation to the Lester S. Levy Collection of Sheet Music, Sheridan Libraries, Johns Hopkins University, as the source of the original, but links to our screwed up pages would probably not be needed. I should note that the JScholarship version of the Levy site (https://jscholarship.library.jhu.edu/handle/1774.2/2085) does not include these false copyright issues. It’s not as visually appealing as the main Levy site, but feel free to link to the JScholarship pages where the main site is screwed up. Best wishes.

Dear Yuriy,

I’ve spoken to our chief librarian about the possibility of your posting an image from MS 1119 on a non-commercial website, and it looks as though that should be ok!

No license needed. Could you kindly attribute the image ‘by permission of the Royal College of Music, London’.

All best,

Michael Mullen

The National Library of Scotland, Edinburgh

Dear Sir / Madam,

my name is Yuriy, I am a dance historian from Moscow, Russia.

I am the author and maintainer of historical dance bibliography database: https://bib.hda.org.ru/

Along with bibliographical information, I am trying to provide digital versions of the primary sources related to historical dance.

I have received the permission to make such sources available online on a non-commercial basis from various institutions and libraries: Bibliothèque nationale de France, Russian State Library and The Royal College of Music and others.

During my recent trip to Edinburgh I took photos of the manuscript “Contre-danse à Paris 1818” which is being held at the National Library of Scotland under call number MS 3860.

I would like to kindly ask the library for permission to make this manuscript available online. I will cite the National Library of Scotland in the same way as the other libraries: https://bib.hda.org.ru/advanced-search?availability=available-here. Is it possible for me to do this?

Thanks in advance.

Best regards,

Yuriy.

Dear Mr Chernyshov,

Thank you very much for your message, and please accept my apologies for this late response. We are happy to give permission for you to mount your images of MS.3860 online, but would be grateful for an acknowledgement to the National Library of Scotland.

Since the images are your own, we would not have to issue you with a licence. However, please note that – with no known author – this manuscript may fall into the category of "orphan works" and may therefore still be in copyright in spite of its age.

If convenient to you, I would be grateful for a link to the images, once they are online.

With best wishes,

Dr Ulrike Hogg

I am the author and maintainer of the world largest historical dance bibliography: https://bib.hda.org.ru/

Along with thorough bibliographical information / links to the digital versions of the primary sources, I am trying to provice (when it is possible links to the primary sources not yes available at the library website). All the content is licensed under CC-BY-NC-SA noncommercial license.

I have got permission to put these books from various libraries including the Russian State Library, the Bibliothèque nationale de France, the National Library of Scotland and many others.

Here is an example of such book: https://bib.hda.org.ru/books/malpied_1762_elemens

Derra de Moroda Tanzarchiv and Salzburg Universitety Library hold a lot of primary sources, which are not available online. So far, I was using EOD portal to order such books, and their license forbids to put ordered items online.

I would like to ask for permission to publish these books on my personal website under non-commercial license. I will credit Salzburg University library for each entry I put online.

Could you (or the other member of the staff) give me such permission?

Regards,

Yuriy.

Dear Yuriy Chernyshov,

since the books ordered from EoD are public domain, you are in fact allowed to put items online as far as the University Library of Salzburg is concerned.

You are actually not allowed to publish public domain works under a CC-BY-NC-SA license since these licenses can only be applied by the author of the work or the institution who digitized the work. Creative Commons offers a Public Domain Mark to be used for works in the public domain (http://creativecommons.org/publicdomain/mark/1.0/), but it’s not necessary to add a license. Just credit the University of Salzburg.

For more information and permissions from the Derra de Moroda Archive you can also contact irene.brandenburg@sbg.ac.at

If you have any further questions, please contact us.

Kind regards
